Fintelite Terms and Conditions

 

These Terms and Conditions (“Terms”) govern your access to and use of the AI-powered document processing and fraud detection services (“Services”) provided by Fintelite Inc. and its affiliates (“Fintelite,” “we,” “us,” or “our”).

 By accessing or using our Services — whether via API, dashboard, or on-premise deployment — you (“User,” “Client,” or “Customer”) agree to be bound by these Terms. If you do not agree, you must not use the Services.

 

1. Overview of Services

Fintelite provides AI-powered document understanding and verification technology to automate data extraction, financial analysis, and fraud detection.

The Services may include, but are not limited to:

1.1 Optical Character Recognition (OCR) and Data Extraction
Extraction of structured and unstructured data from documents (e.g., invoices, receipts, bank statements, ID cards, payslips, financial statements, and contracts) using proprietary AI models.

1.2 Document Verification and Fraud Detection
AI-based detection of tampered or manipulated documents through pixel-level analysis, metadata comparison, signature/stamp forensics, and duplication pattern matching.

1.3 Verification and Enrichment APIs
Validation of data against trusted third-party sources (e.g., sanctions lists, identity registries, or government databases) to verify authenticity and compliance.

1.4 Bank Statement Analyzer and Financial Intelligence
Categorization and analytics on bank statement transactions to assess financial behavior, detect anomalies, and generate structured insights for lending or credit scoring purposes.

1.5 Automation and Workflow Tools
Integration of the Services into client systems through APIs or dashboards, enabling document classification, validation, and report generation in a fully automated workflow.

 

2. User Obligations

2.1 Authorized Use
You represent and warrant that all data submitted to Fintelite is lawfully obtained and that you have the right to use and process such data through our Services.

2.2 Account Security
You are responsible for safeguarding your credentials, including API keys and dashboard access. Fintelite shall not be liable for unauthorized access resulting from compromised credentials.

2.3 Permitted Usage
You agree not to use the Services to process unlawful, defamatory, fraudulent, or infringing materials. Fintelite may suspend or terminate access for misuse, abuse, or violation of these Terms.

2.4 Backup Responsibility
You are responsible for retaining copies of your uploaded and processed data. Fintelite may not store data indefinitely unless otherwise agreed in writing.

 

3. Data Privacy and Security

3.1 Data Processing Role
Fintelite acts as a data processor (or service provider) on behalf of the user, who remains the data controller. Fintelite processes data only for the purpose of delivering the Services.

3.2 Data Ownership
All user-submitted data remains the property of the user. Fintelite does not claim ownership rights.
By submitting data, you grant Fintelite a limited, non-exclusive, revocable license to process it strictly for service delivery and improvement.

3.3 Data Retention and Deletion
Unless otherwise agreed, uploaded documents are automatically deleted within a defined retention period (typically 30–60 days). You may request earlier deletion by written notice.

3.4 Security Measures
Fintelite employs industry-standard security measures — encryption in transit and at rest, network isolation, access control, and audit logs — consistent with ISO 27001principles.

3.5 Data Location and Compliance
Data may be processed in secure cloud environments (e.g., AWS, GCP) in jurisdictions with adequate protection levels. 

3.6 Third-Party Subprocessors
Fintelite may engage trusted third parties (e.g., cloud infrastructure providers or verification partners) for limited processing. These parties are bound by confidentiality and data protection obligations equivalent to Fintelite’s.

 

4. Intellectual Property

4.1 Ownership
All intellectual property rights in Fintelite’s software, algorithms, AI models, UI design, documentation, and APIs remain the exclusive property of Fintelite.

4.2 User License
Fintelite grants you a limited, non-exclusive, non-transferable license to access and use the Services solely for your internal business purposes during the subscription term.

4.3 Prohibited Uses
You must not reverse-engineer, decompile, reproduce, or use Fintelite’s software or data outputs to train or develop competing systems.

 

5. Service Availability and Limitations

5.1 Service Levels
Fintelite targets a 99% uptime for its cloud-based Services. Maintenance windows will be communicated in advance when possible.

5.2 Output Accuracy
The Services use probabilistic machine learning models. While Fintelite strives for high accuracy, it does not guarantee error-free outputs. Users are responsible for verifying extracted data before relying on it.

5.3 Regulatory Use
Fintelite provides data automation and analytical tools but does not replace compliance, audit, or underwriting judgment. Final decisions remain the responsibility of the user.

 

6. Term and Termination

6.1 By Fintelite
We may suspend or terminate your access with notice if you breach these Terms, use the Services unlawfully, or fail to pay applicable fees.

6.2 By the User
You may terminate your account at any time through written notice. Fees already paid are non-refundable once processing has occurred.

6.3 Effect of Termination
Upon termination, access to your account, APIs, and processed data will be disabled. Fintelite will delete all user data within a reasonable period unless otherwise required by law.

 

7. Fees and Payments

7.1 Usage and Billing
Fees are based on the pricing plan or usage volume (e.g., pages processed, API calls). Overages are billed monthly according to your plan.

7.2 Taxes
All prices are exclusive of applicable taxes, which are the client’s responsibility.

7.3 Non-Refundable Fees
Payments are non-refundable once the Services have been consumed or data processing has begun, consistent with industry practices.

 

8. Warranties and Disclaimers

8.1 Disclaimer of Warranties
Fintelite provides the Services “as is” and “as available,” without any express or implied warranties of merchantability, accuracy, or fitness for a particular purpose.

8.2 Limitation of Liability
Fintelite’s aggregate liability under these Terms shall not exceed the total fees paid by the user in the six (6) months preceding the claim.
Fintelite shall not be liable for indirect, incidental, or consequential damages, including data loss, business interruption, or lost profits.

 

9. Compliance and Audit

9.1 Compliance Framework
Fintelite operates in accordance with recognized information security standards such as ISO 27001, SOC 2 Type II, and adheres to applicable data protection frameworks (GDPR, PDPA, PDP).

9.2 Audit and Due Diligence
Enterprise clients may request security documentation, certificates, or third-party audit summaries under a mutual non-disclosure agreement (NDA).

 

10. Changes to the Terms

We may update these Terms periodically to reflect operational, legal, or regulatory changes. Users will be notified of material updates via email or dashboard. Continued use of the Services constitutes acceptance of the updated Terms.

 

11. Governing Law and Dispute Resolution

These Terms are governed by and construed under the laws of Singapore, without regard to its conflict of law principles.
Any disputes shall be settled through confidential arbitration under the Singapore International Arbitration Centre (SIAC) Rules in English.
